Introduction

This law office practices primarily disability law. After many years of focusing on a particular area of law, one becomes reasonably well adept at dealing with medical issues. When it comes to injuries and auto accidents, the medical side of the case has some very similar features to that which we confront in a disability case. Namely, what is wrong with the client and how impaired are they by the injuries.

After years of cross examining medical experts and vocational experts in administrative hearing, the same type of proof skills transition fairly well to injury cases. The whole idea is to demonstrate by medical means, an injury of some substance, and then explore the functional, occupational, & practical impact of those injuries. It is also beneficial in some auto accident cases to "personalize the injury" meaning we try to graphically demonstrate the overall impact on the daily life of the injured person.

In auto accident cases, there are of course other inquiries. One major issue is what we call "causation." In simple terms, did the accident cause the medical problems which the Plaintiff alleges. There are proof issues in auto litigation that meaning, that we have to meet what we sometimes call Daubert threshold criteria in order to get our "expert's" testimony & opinion (i.e. our proof ) into evidence There are usually liability issues to deal with (the idea of who is at fault, or apportioning fault among several parties), there are usually insurance issues (coverage, policy limits, underinsured, uninsured, stacking, bad faith, Coots criteria when policy limits are met, etc), and we have to bear in mind that statues control your time limits to file suit should that become necessary.

Attorney Robert Florio and myself generally work together on these type of injury cases. Robert has office space in my building and is of-counsel to myself. Simply put, this means that he and I co-counsel select injury cases. Robert is a former prosecutor who brings a strong litigation background to the playing field. I generally add skills in form of medical and vocational case development. The combination can be very effective. Also, I have two engineering degrees and will sometimes delve into the math & physics of collisions, when necessary.
